2 BANKRUPTCY
(банкротство) Состояние, когда человек не может заплатить свои долги и суд вынес в отношении его решение о банкротстве (bankruptcy order). Это решение лишает банкрота его имущества, которое идет на оплату долгов. Дело о банкротстве начинается с петиции, которую могут подать в суд(1) кредитор или кредиторы;
(2) лицо, полагающее, что его интересы не были соблюдены при добровольной оплате долгов заемщиком в соответствии с Законом о неплатежеспособности 1986 г.;
(3) прокурор; (4) сам должник. Основанием для подачи петиции кредиторами является неспособность должника погасить долги или уверенность в том, что он не сможет этого сделать в будущем, т.е. тот факт, что должник не смог выплатить долг по выдвинутому в соответствии с законом требованию либо признанный решением суда долг не был погашен. Общая сумма долгов должна быть не меньше 750 ф. ст. Лицо, связанное с должником соглашением о добровольном погашении долга, имеет право подать петицию в том случае, если должник нарушает условия соглашения или утаил важную финансовую информацию. Прокурор может подать петицию, исходя из общественных интересов, в соответствии с Законом о полномочиях уголовных судов 1973 г. Сам же должник подает петицию на том основании, что он не в состоянии расплатиться с долгами. После подачи петиции о возбуждении дела о банкротстве должник уже не имеет права отчуждать что-либо из своего имущества. Суд может по своему усмотрению прекратить любое другое дело, начатое против должника. Назначается промежуточный ликвидатор предприятия должника. Как правило, это-официальный ликвидатор (official receiver), действия которого направлены на недопущение отчуждения чего-либо из имущества должника. В отдельных случаях, если характер деятельности должника требует этого, может быть назначен специальный управляющий (special manager). Суд выносит решение о банкротстве по своему усмотрению. Сразу после вынесения такого решения должник считается невосстановленным в своих правах банкротом. Он теряет право собственности на все свое имущество и обязан помогать официальному ликвидатору в составлении списка имущества, защите и возвращении имущества и т.д. Официальный ликвидатор является управляющим и ликвидатором состояния должника до тех пор, пока не будет назначен попечитель в связи с банкротством (trustee in bankruptcy). Банкрот обязан в течение 21 дня после вынесения решения о банкротстве подготовить официальному ликвидатору отчет о состоянии дел. По заявлению официального ликвидатора или кредиторов суд может распорядиться о проведении открытого разбирательства (public examination), во время которого банкрот обязан в суде отвечать на вопросы о состоянии его дел. В течение двенадцати недель официальный ликвидатор должен принять решение о том, надо ли организовывать встречу кредиторов (meeting of creditors) с целью назначения попечителя в связи с банкротством. Обязанности такого попечителя заключаются в оценке, реализации и распределении между кредиторами имущества банкрота. Попечитель может быть назначен кредиторами, судом или Государственным секретарем; он должен быть квалифицированным специалистом по случаям неплатежеспособности либо официальным ликвидатором. На уплату долгов может быть направлено все имущество банкрота, за исключением следующего: оборудование, необходимое ему для ведения бизнеса, или необходимые для домашнего хозяйства предметы; доход, достаточный для удовлетворения жизненно необходимых потребностей банкрота и членов его семьи. По своему усмотрению суд выносит решение о продаже дома, в котором живут супруга (супруг) или дети банкрота. Все кредиторы должны передать свои претензии попечителю. В случае банкротства принимаются только претензии в связи с необеспеченными долгами. После уплаты всех необходимы расходов попечитель делит состояние банкрота между кредиторами. Закон о неплатежеспособности 1986 г. регламентирует очередность удовлетворения претензий кредиторов (см.: рreferencial creditor( преференциальный кредитор)). Состояние банкротства автоматически прекращается по прошествии двух или трех лет, однако в некоторых случаях требуется специальное решение суда. Банкрот считается восстановленным в правах и получает от суда свидетельство о восстановлении в правах.
